Understanding the Mediation Process in New York
In the state of New York, a court will not grant a Certificate of Dissolution of Marriage until you and your soon-to-be former spouse resolve any disagreements regarding separation terms. Traditionally, spouses litigate disputes in court, but it’s becoming increasingly common for them to pursue matrimonial or divorce mediation. Over the past several years, courts across the state have even begun to order spouses to attempt mediation before reaching the courtroom. This process is known as “presumptive mediation.”
Our Nassau County mediation attorneys have been involved in all phases of the legal process, as personal lawyers and as mediators. So, we understand its benefits, limitations, and complexities. It is a structured process conducted over several sessions with a third-party mediator facilitating communication between both sides. The mediator is not there to benefit one party over the other. The mediator is there to set the agenda, ensure legality, and maintain an environment conducive to cooperation. Mediators can call off the process if they believe discussions are counterproductive.
Should You Consider Divorce Mediation?
Although it’s not appropriate for every situation, there are clear benefits to mediation over traditional divorce-court proceedings. For one, it is often much faster, cost efficient, and less stressful for spouses who are willing and able to negotiate with one another. Additionally, spouses and mediators can coordinate with personal attorneys, mental health experts, financial advisors, and other professionals to negotiate even the most complicated topics.
Furthermore, mediation allows both parties to have greater input in the outcome of their divorce, which can help reduce animosity between them. In our experience, mediation is especially valuable for children, who often suffer the most when contested divorces reach the courtroom.
